Terms of Service
Last updated
These Terms of Service ("Terms") govern your organisation's use of the TourChorus dashboard, rider app experience and related services (the "Service"). By creating an account or using the Service you agree to these Terms on behalf of your organisation ("Customer", "you").
1. The Service
TourChorus lets tour operators create GPS-triggered, multilingual audio tours, publish them to passengers through the TourChorus mobile app, and manage related content, surveys and analytics. We may improve and change the Service over time; we will not materially reduce core functionality of a paid plan during a billing period.
2. Accounts
You are responsible for your users, their roles, keeping credentials secure, and all activity under your account. You must give us accurate information and keep it up to date.
3. Trial, plans and payment
- New organisations may start a free trial (currently 14 days). A payment method is required to start the trial; you will be charged when the trial ends unless you cancel before then.
- Choosing to go live during the trial ends the trial and starts your paid plan immediately.
- Plans are billed monthly in advance and are non-refundable except where required by law. Prices and plan limits (such as active routes, languages and AI credits) are shown on our pricing page or in your order.
- AI credits reset each billing period and do not carry over unless stated otherwise. Purchased top-ups expire as stated at purchase.
- If payment fails or you cancel, your tours return to Preview after a grace period. We do not delete your content because of non-payment; see section 8.
- Taxes are your responsibility except taxes on our income.
4. Your content
You keep all rights to the scripts, audio, images, route data and other material you upload or create with the Service ("Customer Content"). You grant us a worldwide, non-exclusive licence to host, process, translate, synthesise, display and distribute Customer Content solely to provide the Service, including showing it to passengers in the TourChorus app.
You are responsible for Customer Content, including having the rights to it and making sure it is accurate and lawful.
5. AI-generated content
The Service can generate scripts, translations and voiceovers using third-party AI providers. AI output may be inaccurate. You are responsible for reviewing generated content before publishing it. As between you and us, you own AI output generated for you, subject to the providers' terms we pass through to you.
6. Acceptable use
You will not use the Service to: break the law; infringe others' rights; publish content that is unlawful, hateful or misleading; distribute malware; attempt to access other customers' data; overload or reverse-engineer the Service; or resell it without our written agreement.
7. Passengers and data
You will give passengers any notices required by law for the data you collect through your tours (for example survey questions). Our handling of personal data on your behalf is governed by the Data Processing Addendum, which forms part of these Terms. See also our Privacy Policy.
8. Term, cancellation and data export
You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts for material breach of these Terms or non-payment. After termination you may export your Customer Content for at least 30 days on request.
9. Third-party services
The Service relies on third parties (for example app stores, map, payment, AI and messaging providers). Their availability is outside our control, and your use of linked third-party services is subject to their terms.
10. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Otherwise, to the extent permitted by law, the Service is provided "as is" without warranties of any kind, including fitness for a particular purpose. GPS accuracy and mobile connectivity vary, and we do not guarantee that every stop will trigger in every circumstance.
11. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or lost profits or revenue. Each party's total liability under these Terms is limited to the amounts you paid us in the 12 months before the claim.
12. Indemnity
You will defend and indemnify us against third-party claims arising from Customer Content or your breach of section 6.
13. Changes to these Terms
We may update these Terms. We will give at least 30 days' notice of material changes by email or in the dashboard. Continued use after changes take effect means you accept them.
14. General
These Terms are the entire agreement between us about the Service. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent, except as part of a merger or sale of your business. Governing law and venue: to be confirmed.
